Acceptance
Creating an account or using a protected workflow may record your acceptance and its applicable policy version.
Terms for Using Instant Sail
This User Agreement governs access to the Instant Sail website and application, published business websites, proposal and payment workflows, support, documentation, hosted pages, and related business tools. By visiting, creating an account, signing in, submitting information, publishing content, opening a proposal, beginning checkout, or using an Instant Sail workflow, you agree to this Agreement and applicable policies presented with the service.
Data collection, use, security, retention, and privacy rights are described in the Instant Sail Privacy Policy.
Effective date: October 16, 2026 | Version: instant-sail-agreement-2026-10-16.1
Creating an account or using a protected workflow may record your acceptance and its applicable policy version.
You control your business content, users, decisions, legal compliance, and customer commitments.
Fraud, abuse, malware, unlawful content, credential harvesting, and security interference are prohibited.
Payment, identity, cloud, and connected service providers may apply their own terms and policies.
Acceptance
The account-creation interface may require a user to affirmatively accept displayed legal terms before submitting an account profile. Checkout, proposal acceptance, cancellation, and other legally significant workflows may present additional terms or confirmation steps appropriate to that action.
Acceptance and other legally relevant actions may be retained with account, billing, workflow, support, and audit history. Depending on the workflow, records may include the account identifier, action, page path, timestamp, policy-version references, payment-policy reference, IP-derived security metadata, browser details, and related workflow identifiers.
Document Versions
The User Agreement and Privacy Policy display an effective date and version identifier. Signup, billing, and other workflows may also associate refund, cancellation, arbitration, accessibility, cookie, or acceptable-use versions with an action. Instant Sail may preserve prior versions for audit, dispute, account, billing, and workflow-history purposes. Later use applies the version in effect at the time of that later visit or action.
Refunds
Instant Sail subscription access begins with the trial and billing terms shown during signup and checkout. Unless a separate written offer states otherwise, subscription fees may be reviewed for refund within 30 days after the relevant billing period begins. Requests may be reviewed for duplicate charges, billing errors, failed access caused by service-side issues, or other circumstances Instant Sail chooses to review. Payment providers may control timing, settlement, disputes, chargebacks, and provider records. A refund does not waive other rights, obligations, audit records, or provider terms.
Cancellation
Users may cancel account access through the available account, billing, support, or checkout-management path. A request should identify the account email, workspace, and requested action. Cancellation becomes effective when confirmed through the online flow or support-confirmed path.
Instant Sail may retain a cancellation audit record containing an account identifier, timestamp, page path, request source, confirmation status, policy version, and related billing or provider reference. Cancellation stops future access or billing according to checkout and provider terms but does not automatically delete records retained for audit, payment, tax, accounting, security, legal, or dispute purposes.
Dispute Notice
Before filing a claim, the party raising a dispute must send written notice describing the issue, involved account or workflow, requested resolution, and contact information. The parties will have 30 days after receipt to attempt informal resolution. An unresolved dispute may proceed through an applicable small-claims, arbitration, or court path allowed by this Agreement. This process does not prevent urgent relief for unauthorized access, service misuse, infringement, fraud, or security-related harm.
Arbitration
To the maximum extent allowed by law, disputes must first use the written notice process above. If unresolved, either party may require binding individual arbitration instead of court litigation, except for permitted small-claims matters, injunctive relief involving misuse, intellectual-property claims, unauthorized access, or claims that cannot legally be arbitrated. Disputes must be handled individually. Class actions, class arbitration, representative actions, private-attorney-general actions, and consolidated proceedings are waived to the maximum extent allowed by law.
Arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules. If AAA is unavailable, the parties will use JAMS or another mutually agreed neutral provider. Arbitration may occur by video, phone, documents-only submission, or in the user's county unless otherwise agreed. Each party pays its own attorney fees unless law or the arbitrator requires otherwise. Provider fees are allocated under applicable consumer rules, and Instant Sail will pay any company-required fees. Small-claims court remains available where permitted.
Acceptable Use
Users may not use Instant Sail to commit fraud, impersonate another person or business, evade payment obligations, publish unlawful or deceptive content, upload malware, harvest credentials, scrape service data, interfere with security controls, attack infrastructure, send spam, misuse proposal or payment workflows, expose private tax, payment, or customer data publicly, violate another party's rights, or conduct regulated activity without required authority, permits, licenses, consent, or professional review.
Instant Sail may restrict, suspend, remove, or preserve content and records when needed to protect users, customers, providers, security, legal compliance, billing integrity, or platform operations.
Customers
Account owners and workspace administrators are responsible for account users, business records, public website content, customer communications, payment settings, proposals, contractor records, and laws applying to their business. Instant Sail provides operational software and workflow records; customers remain responsible for business decisions, legal and tax review, worker classification, customer promises, pricing, refunds, permits, insurance, licensing, and professional obligations. Review records, documents, payments, and audit events before sending, publishing, signing, accepting, or completing a workflow.
Uploads and Submissions
Users are responsible for public pages, business websites, proposals, customer-facing content, images, files, records, comments, submissions, templates, software, data, and other material they upload, publish, send, or store through Instant Sail.
Do not submit unlawful, defamatory, infringing, deceptive, abusive, harmful, unauthorized, spam, malware, or impersonation content. Do not expose private information, payment secrets, protected tax data, or confidential records unless the workflow is intended and authorized for that data.
Uploads may contain inaccurate information, unwanted files, malicious code, infringing materials, or content violating another party's rights. Users must review content they rely on, send, publish, download, or share.
By submitting content, users grant Instant Sail the limited permission needed to host, display, transmit, process, reproduce, store, secure, route, and otherwise operate that content for the service and requested workflows.
Service Providers
Contractors, vendors, and other third parties using an Instant Sail workflow must provide accurate information, use authorized access paths, and submit records only with authority. Instant Sail does not verify every license, permit, tax status, insurance status, work authorization, business qualification, or legal capacity. Account owners decide whether a provider may perform work, receive payment, access records, or participate in a workflow.
Disclaimer
Instant Sail is not a marketplace broker, employment agency, payroll provider, law firm, tax advisor, insurance provider, bank, payment processor, or guarantor of customer or provider performance. Business websites, proposals, customer and service records, and payment records support workflows, but Instant Sail does not guarantee job quality, customer payment, contractor performance, licensing, insurance, legal compliance, or business results.
Service Limits
Instant Sail does not provide legal, tax, payroll, accounting, immigration, insurance, licensing, or other professional advice. Workflows, templates, documentation, examples, records, and support messages are operational software tools, not substitutes for professional judgment.
Business owners are responsible for applicable federal, state, county, city, tax, labor, permit, licensing, insurance, consumer, employment, and industry requirements.
The site, workflows, documentation, hosted pages, payment views, records, integrations, and services are provided as available and without guaranteed results. To the maximum extent allowed by law, Instant Sail limits liability for service use, third-party integrations, records, availability, indirect or consequential losses, and business decisions made from service outputs.
Cloud actions may create account, proposal, payment, email, support, operational, or audit records to preserve security, workflow history, billing visibility, dispute context, and business continuity.
AI Planning Guidance
The AI Business Guide may send an authorized owner's approved business profile, business-plan information, and question to an AI service provider and may use search grounding. The owner is responsible for reviewing displayed sources and deciding whether an answer, estimate, comparison, or recommendation fits the business and circumstances.
AI and web-grounded results may be incomplete, inaccurate, outdated, or unsuitable. Pricing and market ranges are planning estimates—not guarantees, appraisals, legal advice, financial advice, accounting records, or verified outcomes. The feature does not perform transactions or replace independent professional judgment.
Users must not submit customer information, bank or payment details, tax identifiers, passwords, credentials, private addresses, or other protected information through the AI Business Guide.
Payments
Stripe and other payment providers may control checkout, card handling, subscriptions, settlement timing, disputes, refunds, chargebacks, verification, taxes, notices, and provider records. By using payment workflows, users also agree to applicable provider terms and privacy policies. Instant Sail may display payment status and proposal-payment summaries for workflow visibility, but provider records remain the controlling payment records.
Data Processing
Where Instant Sail processes personal information or business records on behalf of an account owner, that owner determines what is submitted, published, sent, stored, or processed. Instant Sail processes the information to provide hosting, authentication, backend workflow handling, support, security, audit history, payment and proposal visibility, and related operations. Users must not submit protected third-party information without the authority, consent, and legal basis required for that workflow.
Details about data collection, providers, security, retention, and privacy rights appear in the Privacy Policy.
Site Materials
Instant Sail names, logos, graphics, documentation, software, page layouts, hosted service content, workflow examples, and code examples are protected by copyright, trademark, contract, and other applicable rights.
Users may access site materials only for ordinary evaluation and use of Instant Sail. Scraping, data mining, credential harvesting, bulk copying, unauthorized commercial reuse, or unauthorized extraction of content, account data, business websites, documentation, hosted materials, or service data is prohibited.
Copyright
Copyright owners may submit a DMCA notice identifying the copyrighted work, allegedly infringing material, affected URL or workflow, contact information, a good-faith statement, a statement under penalty of perjury that the notice is accurate and authorized, and a physical or electronic signature. Where permitted, users whose material is removed may submit a counter-notice identifying the material, providing contact information, stating under penalty of perjury that removal resulted from mistake or misidentification, consenting to required jurisdiction, and including a signature. Repeat infringement may result in account restriction, content removal, or termination.
Electronic Notices
By using Instant Sail, users consent to electronic communications through email, in-app and posted notices, proposal links, workflow notices, account and support messages, and provider notices connected to requested workflows.
Instant Sail may update policies, documentation, workflows, features, notices, terms, and provider integrations. Continued use after an update means the updated terms and notices apply to later visits, account access, and workflow use.
Legal Notices
Instant Sail is operated by Instant Sail. Legal notices must be submitted through the current support workflow. This Agreement is governed by Texas law without regard to conflict-of-law rules. Subject to the arbitration and small-claims provisions, the exclusive venue for permitted court proceedings is Dallas County, Texas.
Copyright, trademark, infringement, website-hosting, uploaded-asset, or public-facing content complaints should identify the affected URL or workflow, describe the issue, include contact information, and provide enough detail for review.
Support, billing, privacy, accessibility, copyright, cancellation, refund, and dispute requests may create support and audit records containing account identifiers, request category, page path, workflow reference, timestamp, supplied details, response status, and resolution history. Response targets may vary by request type, account status, provider dependency, legal review, and operational priority.
